These terms and conditions ("Terms") are the terms and conditions on which we make the Discovery Sites available to you. We may, but have no obligation to, remove User Submissions (as defined below) containing content that Discovery in its sole discretion determines is unlawful, offensive, threatening, libellous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms. "User Submissions" means visual and textual content collectively and individually, including without limitation photographic and video content.

Your Use of the Discovery Sites

You agree that you will only use the Discovery Sites in a manner that is consistent with these Terms and in such a way as to ensure compliance with all applicable laws and regulations and provided you agree:

you are aged 18 years or older;
you agree not to distribute in any medium any part of the Discovery Sites, including but not limited to User Submissions without Discovery's prior written permission;
you agree not to alter or modify any part of the Discovery Sites and all its related technologies;

Our Intellectual Property Rights

Materials Posted by you

As a User of the Discovery Sites you may submit User Submissions. You understand that whether or not such User Submissions are published, Discovery does not guarantee any confidentiality with respect to any User Submissions.

You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. With respect to User Submissions, you affirm, represent and/or warrant that: you own or have the necessary licenses, rights, consents and permissions to use and authorise Discovery to use all patent, trade mark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable use of the User Submissions in the manner contemplated by Discovery on the Discovery Sites.

Discovery will terminate a User's access to the Discovery Sites if, under appropriate circumstances, they are determined to be a repeat infringer.

Discovery reserves the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. Discovery may remove such User Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.

you agree not to access User Submissions or Discovery content through any technology or means other than the graphical user interface provided by Discovery or other explicitly authorised means Discovery may designate;
not to access the User Submissions with a view to harvesting data or any other element from the Discovery Sites;
not to use the Discovery Sites for any commercial use, without the prior written authorisation of Discovery. Prohibited commercial uses include any of the following actions taken without Discovery's express approval:
- sale of access to the Discovery Sites or related services on another website;
- use of the Discovery Sites or related services, for the primary purpose of gaining advertising or subscription revenue;
- the sale of advertising, on the Discovery Sites or any third-party website, targeted to the content or specific User Submissions; and
- any other use of the Discovery Sites, or related services that Discovery finds, in its sole discretion, to use Discovery's resources or User Submissions to have the effect of competing with or displacing the market for Discovery, Discovery content, or User Submissions.
Prohibited commercial uses do not include:
- uploading original content to the Discovery Sites;
- using the Discovery Sites to show content on an ad-enabled blog or website, provided the primary purpose of using Discovery is not to gain advertising revenue or compete with Discovery; and
- any use that Discovery expressly authorises in writing.
you agree not to use or launch any automated system, including without limitation, "robots", "spiders", or "offline readers" that accesses the Discovery Sites in a manner that sends more request messages to Discovery services in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, Discovery grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials, Discovery reserves the right to revoke these exceptions either generally or in special cases. You agree not to collect or harvest any personally identifiable information from the Discovery Sites or to use the communication systems provided by Discovery (e.g. comments or posts) for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the Discovery Sites with respect to their User Submission.
you will otherwise comply with the terms and conditions of these Terms, the Discovery Community Guidelines as set out below, and all applicable local, national, and international laws and regulations.
Discovery reserves the right to discontinue any aspect of the Discovery Sites at any time.

Linking and Framing

We are not responsible for, and cannot guarantee the performance of, goods and services provided by advertisers on the Discovery Sites or others to whose sites we link.

Community Guidelines

The Discovery Sites include a forum for you to share your photos and videos and other content with the Discovery community, or such parts of it as you may choose.

We hope you enjoying using the Discovery Sites, but ask that you respect these Guidelines in addition to the Terms:

Only post on the website material that is owned or created by you or in respect of which you have the owner's or creator's permission to post;
Do not introduce any virus or any other harmful computer software code into the Discovery Sites;
Do not use the Discovery Sites to gather personal information of other users and/or send other users unsolicited advertising or emails;
Do not post any material on the Discovery Sites that could be seen as being obscene, pornographic, defamatory, offensive, gruesome or violent;
Do not use the Discovery Sites in order to or commit any criminal offences or to incite anyone else to do so;
Do not use the Discovery Sites to harass or bully anyone or post any material which could be seen as being offensive, discriminatory, racist, sexist, hateful or harmful in any way;

If you are found to be in violation of any of the above Guidelines we may remove any User Submissions made by you.

TERMINATION OF ACCESS TO DISCOVERY SITES

Discovery will terminate a User's access to the Discovery Sites if, under appropriate circumstances, they are determined to be a repeat infringer.

ABILITY TO ACCEPT TERMS OF SERVICE

Discovery is concerned about the safety and privacy of all its users, particularly children. For this reason, parents who wish to allow their children access to the Discovery Sites should assist them in setting up any relevant accounts and supervise their access to the Discovery Sites. By allowing their children to use the Discovery Sites parents or guardians also accept responsibility for the conduct of minors online as well as for the consequences arising from misuse of the Discovery services by minors. Parents or guardians also acknowledge that minors will be able to access all User Submissions, and despite our best efforts to moderate them, User Submissions may be unsuitable for minors, therefore as the legal guardian, it is your responsibility to determine whether any of the User Submissions and/or content are appropriate for your child.
